The environmental permit is an administrative act issued by the competent Ministry relating to plants and facilities that have or may have a negative impact on the environment. The environmental permit must be obtained in the case of:
1. construction and commissioning of new facilities and plants,
2. significant changes in the operation of existing facilities and plants,
3. existing facilities and plants which were granted permits prior to entry into force of the Law (not later than 2008).
The environmental permit (in cases 1 and 2) aims to ensure that the Investor has anticipated at the earliest stage of project development the measures to prevent negative impacts that the project may have on the environment. Therefore, the environmental permit must be obtained before the urban planning approval, and it must be attached to the request for the issuance of urban planning approval.
The issuance of the environmental permit is regulated by the F BiH Law on Environmental Protection as well as by cantonal laws. The Cantonal Ministry of Land-Planning, Construction and Environmental Protection issues environmental permits in accordance with the Cantonal Rulebook for Plants and Facilities not requiring Environmental Impact Assessments as well as for facilities and plants below the threshold determined by the Federal Rulebook.
For plants and facilities not requiring an environmental permit, the competent authority shall take into account the fulfillment of environmental protection requirements prior issuance of an urban approval. The maximum period for obtaining an environmental permit is 120 days from the date of submission of the request for issuance of the permit.
